1. Agreement to Terms

By downloading, installing, or using the thrivelo mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute the entire agreement between you and Thrivelo ("we", "us", or "our") regarding your use of the App.

2. Description of the App

thrivelo is a personal health and fitness tracking application that allows you to:

• Log and track workout sessions, exercises, sets, reps, and personal records
• Record daily food intake, macronutrients, and calorie consumption
• Track body weight, body fat percentage, and related health metrics
• View trends and progress over time

The App is intended for personal, non-commercial use as a private record-keeping tool. It is not a medical device and does not provide medical advice.

3. Medical Disclaimer

thrivelo is not a medical application. The calculations and information the App provides, such as BMI, BMR, TDEE, calorie estimates, and nutritional data, are for personal tracking purposes only. They are not clinical measurements.

Nothing in the App is medical advice, diagnosis, or treatment. Consult a qualified healthcare professional before starting any exercise programme, making significant changes to your diet, or if you have any health concerns.

4. Eligibility

You must be at least 16 years of age to use the App. By using the App, you represent that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

5. Intellectual Property

The App, including its design, code, branding, graphics, and content, is the proprietary property of Thrivelo and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.

You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works of the App or any part of it.

6. Third-Party Services

The App integrates with the following third-party service:

• Open Food Facts — Used to search for nutritional information and retrieve product data via barcode scanning. When you search for food or scan a barcode, your query or barcode is sent to the Open Food Facts API. Open Food Facts is a free, open, collaborative food database operating under its own terms of use.

We are not responsible for the accuracy, availability, or content of third-party services. Your use of those services is subject to their respective terms.

7. User Responsibilities

You agree that you will not:

• Use the App for any unlawful purpose
• Attempt to gain unauthorised access to any systems connected to the App
• Use the App to transmit harmful, offensive, or malicious content
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices in the App

8. Disclaimers

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the App will be error-free, uninterrupted, or free of harmful components.

Nutritional data sourced from Open Food Facts or entered by you may be inaccurate or incomplete. We make no representations about the accuracy of any nutritional, fitness, or health information in the App.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Thrivelo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App. This covers loss of data, personal injury, and health consequences from relying on information in the App.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve months before the claim, or £10, whichever is greater.

10. App Updates and Availability

We may update, modify, or discontinue the App (or any part of it) at any time without notice. We do not guarantee that the App will remain available or that any particular feature will be maintained.

11. Changes to These Terms

We may update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. Continuing to use the App after changes are posted means you accept the revised Terms. We recommend checking this page occasionally.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
